Leaked advice deals blow Michael Gove new schools row

Michael Gove, under-fire Education Secretary, has been warned to confidential advice from a leading QC who Local authorities have a case of "very strong" in efforts to cover legal costs incurred by programs canceled school building. Tips, discovered Sunday Telegraph, is the latest blow to Mr. Gove as he battles against the consequences of his announcement failed last month in which he axed more than 700 projects. At least two local authorities - Sandwell and Nottingham City Council - are known to prepare for possible legal challenges, as well as several other councils may follow the move which could see the taxpayer facing charges totaling hundreds of millions of pounds . Advice to Mr. Gove came from James Goudie QC, one of the country's leading experts in administrative and public law, who was summoned to the Department for Education (DfE).Mr advice Goudie's, sent on July 22, reassures Mr. Gove building that private firms would have little chance of a successful challenge for compensation - unless local authorities have promised to contractors. However, he adds that the Council could have "a very strong case" to recover any costs incurred if their plans based on insurance or finance secretaries of education from the current or previous.Mr advice Goudie is another blow to Mr. Gove, who is apparently trying to base its decisions on which projects give schools what kind of school they are or what stage of construction project has reached. Last week, Secretary of Education said all academies and so-called "model schools" - pilot projects by the local authorities are yet to launch a broader program of construction - will take some or all of funding their expectations.Mr. Goudie recommends instead that the decision on individual cases should be assessed on the basis of reasonable assurance of funds obtained advice. Last month found that Mr. Gove had ignored the advice of his officials, going forward with the announcement of schools taken £ 55000000000 Building for the Future (BSF) initiative before wider consultation. DfE said the newspaper story was "wrong" - only for it to be confirmed in evidence to Commons committee of all parties choose education.Ed Balls, shadow education secretary, said: "Now the evidence is clear just what a huge and wasteful gamble Michael Gove has taken taxpayers' money. He has threatened the worst of all worlds - a project greater compensation, but no new school buildings to show for it.
